Terms of service

1. Acceptance of Terms

These terms are an agreement between the school and Patashala360, Behind Indur Engineering College, Siddipet, Telangana, India ("we", "us", or "our"). By accessing or using Patashala360, you agree to comply with and be bound by these Terms of Service and all applicable laws and regulations, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and other relevant Indian laws.

2. Eligibility and accounts

Our platform is intended for use by schools, educational institutions, their staff, students, and parents. By using the platform, you represent that you have the authority to enter into this agreement on behalf of your institution or as an individual user. Staff, parent and student accounts are created by the school, and a person can only sign in with an account the school has issued.

3. User Accounts & Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials, including printed login slips.
• All information provided must be accurate and up to date.
• Unauthorized use of another person's account is strictly prohibited.

4. The school's responsibilities

• The school decides what student, parent and staff data it records and is responsible for its accuracy.
• The school obtains any consent the law requires, including a parent's consent for processing a child's data.
• The school decides which staff get access and what each role can do, and removes access when a person leaves.

5. Data Privacy & Security

We handle personal data as described in our Privacy Policy and applicable Indian data protection laws. For student, parent and staff records, the school decides what is recorded, and we process it only on the school's instructions.

6. User Content

• You retain ownership of any content you upload or submit, but grant us a license to use, display, and process it for providing our services.
• You must not upload content that is unlawful, harmful, or infringes on the rights of others.

7. Prohibited Activities

• Misuse of the platform, including hacking, data scraping, or unauthorized access, is strictly prohibited.
• You may not use the platform for any illegal or unauthorized purpose.

8. Licence, fees and payment

• The school buys a yearly licence priced per student, for the plan and student limit shown on its invoice.
• We issue an invoice. The school pays by UPI, bank transfer or cheque, and the licence runs for the term shown on the invoice once the payment is recorded.
• At renewal, the price per student will not rise by more than 10% over the previous year.
• Fees are non-refundable except as required by law or as specified in a separate written agreement.

9. When a licence ends

• The school sees a reminder in the application 30 days before the licence ends.
• For 15 days after the end date, everything keeps working.
• After that the school becomes read-only: staff can view every record, but changes are paused until the renewal payment is recorded. Access returns as soon as it is.
• Parents and students keep their access, and no data is deleted because a licence has ended.

10. Mobile app

A mobile app for parents, students and teachers is launching soon on Google Play. Once it is released, your use of Google Play is also governed by Google's own terms.

11. Intellectual Property

All content, trademarks, and software on Patashala360 are the property of Patashala360 or its licensors. You may not copy, modify, or distribute any part of the platform without written permission.

12. Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability is limited to the amount paid by you for the services.

13. Indemnification

You agree to indemnify and hold harmless Patashala360, its affiliates, and employees from any claims, damages, or expenses arising from your use of the platform or violation of these terms.

14. Suspension and termination

• We may suspend or end access to the platform for a violation of these terms or applicable laws. We tell the school why, unless the law prevents us.
• A school may stop using Patashala360 at the end of any licence term. Before its data is deleted, the school can download all of it to Excel. We then delete it as described in our Privacy Policy.
• A person can ask for their own account to be deleted. See how to delete your account.

15. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the platform after changes constitutes acceptance of the new terms.

16. Governing Law

These terms are governed by the laws of India. The courts at Siddipet, Telangana have exclusive jurisdiction over any dispute.
